Welcome to our marketing content aggregator platform, PEODY. Before you start using our service, please read the following terms of service ("Terms") to get a full understanding on the use of the PEODY platform (the "Service") operated by PEODY ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms applies to all users who access or use the Service. By accessing or using the Service you agree to be bound by these Terms.
1. Introduction
Our marketing content aggregator platform sources and displays content from various public sources available on the internet. While we make every effort to ensure the accuracy and quality of the content, we do not guarantee its completeness or accuracy, and we are not responsible for any errors or omissions in the content.
What we do: we provide a platform where businesses (collectively, “Publishers”) can publish offers and discounts for exclusive user groups to avail and as a marketing aggregator platform provider, we enable users locate their exclusive offers & discounts in one place using the Service.
How we do it: we aggregate content from various online platforms while giving due credit to the owner of the source platform by explicitly referencing the name/entity of the source platform. We also provide a venue for companies (collectively, “Hosts”) to enroll and publish exclusive members-only offers with their community to avail. We also provide the ability for the general public (collectively, “Contributors”) to contribute to the information contained on our platform. We are not a publisher, a contributor, or a host; we provide a platform that aggregates information from various sources to make it easier for end-users (collectively, 'Users') to locate relevant information in one place.
Important Disclaimer - All product names, logos, photos and brands are property of their respective owners. All company, product and service names used on the website are for identification purposes only. Use of these names, logos, and brands does not imply endorsement nor affiliation.
2. Agreement
By using our marketing content aggregator platform (the 'Service'), you agree to these terms and conditions, our Privacy Policy, and any additional guidelines or rules that may be posted on the platform from time to time. The Service uses Google Maps APIs and thereby by using the Service you are also bound by Google’s Terms of Service. If you do not agree to these terms, you should not use our service.
3. Disclosure
The Service do not sell, share or disclose your information, nor do we give it to others to sell you anything. We use it so the Service can filter information based on your selections and make the Service more engaging and accessible for you. Put simply: we use the information shared with us solely to make the core functions of the Service work for you. Please refer to our Privacy Policy for more information about what information is required for core functions of the Service to work, what are the choices, type of information collected and how we process the information.
4. GPS & Location Information
Automatic location-based function in the Service works if you consent to share your location. But it's completely up to you whether or not you want the Service to use geolocation tools, it can only be enabled if you consent to it. If you consent, the Service uses your location to only show you more relevant content closest to you and it remains strictly confidential. As an alternative, you can choose to set a manual location and change it as often as you want it. It is solely used to filter content relevant to the location.
5. Terms specific for Users
5.1 The terms and conditions of the discounts and offers aggregated from various sources are subject to the Publisher's own terms and conditions. While we make every effort to ensure the accuracy and quality of the content, we do not guarantee its completeness or accuracy, and we are not responsible for any errors or omissions in the content. Users should check the Publisher's terms and conditions before using the information in the Service.
5.2 The offers and discounts information on the Service are subject to availability and change. PEODY accepts no responsibility for lack of availability or any change. Errors/invalidities spotted by Contributors and shared with us helps us improve the accuracy of information in the Service.
5.3 The discounts and offers offered may be withdrawn anytime. PEODY accepts no responsibility if a Publisher no longer provides the discount/offer or has withdraw it before the end of the validity period references on the Service.
5.4 PEODY makes no guarantees, warranties or representations of any kind concerning the Publishers and/or the services, products, activities and/or discounts or offers provided by the Publishers. In the event that you find the services, products or activities provided by a Publisher unsatisfactory you must make a claim against the Publisher.
5.5 PEODY disclaims all liability for any services, products, activities and/or discounts and offers provided by a Publisher on the Service.
5.6 The Publishers are not affiliated with PEODY. PEODY is not responsible if the Publisher fails to honor any discount or offer.
5.7 PEODY disclaims all liability for any loss and/or damage incurred:

By a user;
-
To a user's property;
-
To a user's companions or to their respective personal property;
as a result of the user of the Publisher's services, premises and/or activity.
Participation in any of the discounted events, purchase of a product and consumption is at the user's own risk.
5.8 PEODY shall have no liability whatsoever whether direct, indirect or consequential for any loss, damage, accident, injury or expenses incurred or by the user and/or any of the user's companions arising under the Terms and/or resulting from the use of the Publisher's services, products or activities shared on the Service.
5.9 Any user contribution to the Service is considered non-confidential and non-proprietary information. We are not responsible, or liable to any third party for the content or accuracy of the information in the Service.
6. Terms specific for Publishers
6.1 When publishing an Offer or Discount through the PEODY Platform you must (i) provide complete and accurate information about your Offer or Discount (such as precise short description of what the incentive for the end user is), (ii) disclose any specific terms, restrictions (such as when offer/discount does not apply) and specify any terms & conditions (such as any minimum spend-amount/period, blackout dates, maximum number of persons eligible to redeem per each eligible cardholder), (iii) ensure that you're in agreement to honor the offer/discount to the exclusive members selected for each offer/discount without limitation on how many times it may be used during offer/discount validity period, and (iv) provide any other pertinent information requested by PEODY. You are responsible for keeping your offer/discount information (including validity period) up-to-date at all times.
6.2 You are solely responsible for setting the value of your Offer/Discount. Once a User requests to use your service or buy your product in accordance to the specified description/terms & conditions of your published Offer/Discount, you may not modify the Offer/Discount and make the User get less discount (or pay more) than what's specified in the published Offer/Discount, unless the information was not sourced accurately.
6.3 Any terms and conditions included in your Offer/Discount, in particular in relation to validity, must not conflict with these Terms or the relevant validity policy for your Offer/Discount.
6.4 The placement and ranking of Offers/Discounts in search results on the PEODY Platform may vary and depend on a variety of factors, such as User's search parameters, location, notification preferences, public reviews/ratings.
